PunjabNewsline.com - “Gay marriages are not acceptable in Sikhism ...

An Opinion:

Hukamnama Sri Akal Takhat Sahib

“Gay marriages are not acceptable in Sikhism and have no place in Gurmat”

By Balbir Singh Sooch, Advocate, Ludhiana

The marriage is like interpreting the Words of Wisdom and Foolishness differently according to the suitability of individuals and the intellectuals and under the circumstances, the diktat, “Gay marriages are not acceptable in Sikhism and have no place in Gurmat” because pronounced by ‘Sri Akal Takhat Sahib’, the supreme temporal (worldly) authority of the Sikhs, has to be accepted as only a balanced edict by Sikhs.

There is nothing exceptional or special to deny or accept in the edict about the gap between the truth and the falsehood prevailing in a section of humans on the issue and in the direction of preventing trespassing in the privacy and the dignity of the consented section of humans.

It is worth to quote here on the lines to deny or accept the balanced edict by Sikhs that the humourous Justice (retd) Manmohan Singh Liberhan said: “I am afraid of only two kinds of people, my wife and journalists. Other than that, I only follow my conscience. Unnecessary controversies don’t bother me.”

In the sense, Liberhan’s humour could be disbelieved only because that’s reported by the Indian Press, the commercial managements otherwise it must be considered very much true and correct like the judgment of the Delhi High Court Sets Historic Benchmark on ‘Sexuality Equality’ which based on and upholds the basic structure of our constitution, that was being ignored in India so far.

To my mind, under the circumstances, the diktat is a balanced directive and strictly not violating the very good thought, “being a Sikh is being an activist - and it is our responsibility as Sikhs to protect the human rights for any individual or community suffering.”

‘Sri Guru Granth Sahib’ has no confrontation with the rule of law or the Indian constitution on the issues of human rights and or the United Nations Charter of human rights whereas, other religions do have confrontation on the issues of human rights and discriminating openly.

It is already said,” The right or positive ways of living always preached versus the named individualistic, sadistic or negative style of living anytime and anywhere without hurting third party and each other could always not be unacceptable, might be said unprogressive and non-developing in the modern or idealistic world.

And such ways are not denied or out rightly condemned in Sri Guru Granth Sahib rather discussed for balancing humanly living as there are five vices (habitual desires) outlined in the Guru Granth Sahib that one should try to control.

Sometimes, the same people realized that the sorrowful songs and actions and the joyful are equally entertaining for them.

The individuals and the intellectuals, in the context, are free to interpret the Sri Guru Granth Sahib to make their point on the subject of marriage either way.

But, when the concept or institution of marriage is to be literally glorified, it has to be done as the union of two souls, husband and wife, man and woman, male and female, the most natural recognized model of marriage in the world as well as by the Sri Guru Granth Sahib.

But, now, in view of the Delhi High Court Sets Historic Benchmark on Sexuality Equality, the counterargument to be accepted that man and woman are only mentioned in this way to give light to the relationship of the soul and the soul force as being one. This denies gender and sex as an issue.

The marriage is like interpreting the Words of Wisdom and Foolishness differently according to the suitability of individuals and the intellectuals”.

The consensual sex freedom or otherwise any actions humanly are mainly connected with questions of difference between the rights and wrongs or the truth and the falsehood in the context of the privacy and the dignity of each individual.

By trespassing the privacy and the individual dignity of consented parties is always wrong and unwarranted under the law.

From the judgment, it looks as the basic structure of our constitution was being ignored in India so far.

UN called the judgment as a land mark ruling in India from human rights angle and to encourage more HIV victims to come forward to seek treatment and information.

Now, it looks as India also slowly submitting before the world opinion and agreeing to reduce the gap between the truth and the falsehood, preached hypocritically by many means in India.

The worldwide joyous mood and opinion of the section of society must be honored and respected. The freedom is also not without riders”.

“What is ethical legally, keeping in mind, my views and yours?

Unethical for whom, for you and I or the parties involved for preventing trespassing in their privacy and dignity?

I am of the opinion that the decision will definitely reduce the gap between the truth and the falsehood, preached hypocritically by many means in India and elsewhere.

The court has not granted absolute freedom but strict restrictions are imposed in the Judgment, normally not followed by the consensual parties”.

If at all anything done, deliberately and intentionally, against the spirit and the teachings of  ‘Sri Guru Granth Sahib’, in violation of the final order and the affirmation of the sacred text Adi Granth by Guru Gobind Singh in October, 1708, the tenth Guru in Sikh tradition as his successor, terminating the line of human Gurus, and elevating the text to Guru Granth Sahib, is and shall be an act against humanity and must always be considered so”.
